Terms and Conditions

These Terms and Conditions govern access to and use of the My QR Menu website, restaurant software, QR menu, ordering, point-of-sale, kitchen, printing, reporting, integration and related services. By creating an account, subscribing to a plan or using the services, you agree to these Terms.
1. The Service
My QR Menu provides software tools that help restaurants publish digital menus and manage supported restaurant workflows. Features may differ by plan, configuration, device, location or integration. We may improve, modify or replace features where reasonably necessary to operate, secure or develop the service.
2. Restaurant Accounts
You are responsible for keeping account credentials secure, maintaining accurate account and restaurant information, controlling staff access and promptly notifying us of suspected unauthorised use. Actions performed through your authorised account are treated as actions of your restaurant unless applicable law requires otherwise.
3. Restaurant Content and Operations
The restaurant is responsible for menu descriptions, prices, taxes, service charges, product availability, allergen and dietary information, order acceptance, preparation, fulfilment, refunds, customer service and compliance with laws that apply to its business. My QR Menu provides technology and does not become the seller of a restaurant’s food or other products merely because an order is processed through the platform.
4. Plans, Fees and Billing
Paid features are provided according to the plan, billing cycle, price and limits displayed or otherwise agreed when the subscription is purchased or renewed. Applicable taxes or payment-provider charges may apply. Where a plan renews automatically, the renewal is subject to the billing information presented for that subscription and applicable law. Plan limits may restrict access to particular modules or usage levels.
5. Payments and Third-Party Providers
Payment gateways, messaging services, accounting services, printers, delivery tools and other integrations may be provided by independent third parties. Their own terms, availability, fees and privacy practices may apply. The restaurant is responsible for maintaining any third-party account or merchant relationship required for an integration.
6. Acceptable Use
You must not use the service to violate law, infringe another person’s rights, distribute malicious code, interfere with system security, gain unauthorised access, misrepresent your identity, abuse platform resources or conduct fraudulent or deceptive activity. We may restrict activity that creates a material security, legal or operational risk.
7. Availability and Maintenance
We aim to provide a reliable service, but continuous or error-free availability cannot be guaranteed. Maintenance, internet conditions, hosting infrastructure, third-party services, devices and other factors outside our reasonable control may affect availability. Where practical, we will take reasonable steps to restore affected services.
8. Data and Privacy
Personal information is handled in accordance with the My QR Menu Privacy Policy. Restaurants are responsible for determining and complying with their own obligations for customer and employee information that they collect or process through restaurant operations.
9. Intellectual Property
My QR Menu and its software, branding, interfaces, documentation and platform materials are protected by applicable intellectual-property laws. Except for the rights needed to use the subscribed service, no ownership rights are transferred to you. You retain responsibility for content that you submit and grant us the permissions reasonably required to host, process and display that content for provision of the service.
10. Suspension and Termination
Access may be suspended or terminated where reasonably necessary because of non-payment, serious or repeated breach of these Terms, unlawful activity, security risk, abuse of the service or discontinuation of a service. Any rights and obligations that by their nature should survive termination will continue to apply.
11. Disclaimers and Liability
To the extent permitted by applicable law, the service is provided on an as-available basis. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. Subject to those mandatory rights, My QR Menu is not responsible for indirect or consequential loss arising solely from restaurant operations, third-party services or circumstances outside our reasonable control.
12. Changes to These Terms
We may update these Terms to reflect changes to the service, law, security or business operations. The current version will be published on this page with an updated date. Continued use after an update takes effect constitutes acceptance where permitted by applicable law.
13. Governing Law
These Terms are governed by the laws of Malaysia, without limiting any mandatory rights that apply under applicable law. Any dispute should first be raised with us in good faith so that the parties can attempt to resolve it.
